Please be noted that this “Terms of Services” is translation of Japanese one and that this is only for your reference.

 

Arata Co.,Ltd. (“We/Us/Our”) prepared this Privacy Policy (“Our Policy”) to explain our privacy practices.  Herewith we announce how we handle the user’s personal information we collect via our websites and services.

 

 

What Information Corresponds to Privacy Information

In all the various privacy information we collect, “Personal Information” means “Personal Information” which is dealt in the Act on the Protection of Personal Information, and it includes information which enables to identify a specific person such as name (Including nicknames used on websites. The same applies to hereinafter.), date of birth, mailing address, phone number, contact address, and other descriptions.

“Historical Information and Characteristic Information” which is also included in privacy information means those which don’t apply to “Personal Information” in above.  “Historical Information and Characteristic Information” includes services which the user used, items purchased, record of pages and advertisements viewed, words searched, date and time of access, way of use, usage environment, post code, sexuality, occupation, age, the user’s Internet Protocol address, Cookie information, location information, and terminal’s identification information etc.

 

 

How We Collect Privacy Information

We ask the user various information such as his/her name, date of birth, mailing address, phone number, email address, bank account number, credit card number, and driver’s license number at registration if it’s necessary.  Also, we sometimes collect from our business partners (“Partners”) the user’s transaction report including personal information and information regarding payment which were handled between the user and our partners.  Partners includes the information suppliers for our websites/services, sponsors/advertisers, the places where we put our information or advertisings.

We collect historical information of the services and software which the user used, items purchased, record of pages and advertisements viewed, words searched, date and time of access, way of use, usage environments (it includes portable terminal’s information of network communication status and system setting when accessing), Internet Protocol information, Cookie information, location information, and terminal’s identification information when the user use our services or our partners’ services, or the user view our websites or partners’ websites.

 

 

Purpose of collecting and using privacy information

We collect and use the user’s privacy information because of following purposes;

 

(i) To enable the user to see his/her registered name, mailing address, contact address, payment method, services he/she used, items purchased and their payment record, in order to check and change the registered information and see the usage history.

(ii) To contact or to send notifications to the user by email, or to send purchased items to the user and contact when needed using the user’s information.

(iii) To use the user’s name, date of birth, mailing address, phone number, bank account number, credit card number, driver’s license number, and result of posting with delivery certification for identity verification.

(iv) To make invoice and ask for the payment to the user, we use information related to payment such as the purchased item’s name, quantity, what kind of/how long/how many times the service was used, amount billed, name, mailing address, and bank account/credit card number.

(v) To pay money to the user, we use information related to payment such as the purchased item’s name, quantity, what kind of/how long/how many times the service was used, amount billed, name, mailing address, and bank account/credit card number.

(vi) To enable the user to enter the needed information easier, we use the user’s information to pre-put the registered information in the input boxes, or pre-send the registered information to the other services (including our partners’ services) according to the user’s instruction.

(vii) To specify specific users who violate the terms of services such as delay in payment or damaging the third parties, and who try to use our services and buy our items for wrong and injurious purposes.  We specify those users by using information such as the users’ utility forms, names, and addresses to refuse those users’ using our services/websites.

(viii) In order to enable ourselves to answer the user’s inquiries, we collect and use information regarding the details of the inquiry and payment which we need to know to provide our items and services, information of the user’s usage status of our items and services, and the user’s contact information.

(ix) To inform the user of our new sales items’ and services’ details, development, and release.

(x) For purposes which associate with (i) through (ix).

 

 

Sharing The User’s Information With The Third Parties

We never give the user’s private information to the third parties without getting permission from the user in advance except for in the cases mentioned below.  In addition, cases which are allowed in the Act on the Protection of Personal Information and other relative laws are also exception.

(i) When it’s based on law.

(ii) When it’s necessary to save human’s life, body, and property, and when getting permission from the user is difficult.

(iii) When it’s necessary to keep public health and children’s healthy raising, and when getting permission from the user is difficult.

(iv) When we need to help national government organizations, local public organizations, and parties who are confided by the organizations carry out works based on law, and when getting permission from the user has possibility to disturb the works.

(v) When we inform and announce the following notices in advance;

– Possibilities that information will be given to the third parties to use

– Which data will be given to the third parties

– How to give the personal information to the third parties

– Providing the personal information to the third parties will be stopped when the user requests so.

Regardless of what is explained above, in the following cases it is not regarded as “giving personal information to the third parties”.

(i) When we consign a part of, or all of the management of private information to outsiders.

(ii) When the private information needs to be shared at succession of business for merger or other possible reasons.

(iii) When we share and use the user’s private information with specific person/parties under the condition that the user is informed of, or the user anytime can see the situation, which information is shared, who we share the private information with, the purpose of the use of the private information, and the name of who/what has the responsibility to manage the private information.

 

 

Disclosure of Private Information

We disclose the user’s private information right away to the user himself/herself when the user requests us to do so.  However, if the following things happen because of disclosure of the private information, we do not disclose a part of, or all of the information.  We inform the user right away if we judge that we do not disclose the information.  We charge the user 1000JPY per 1 time for handling charge at disclosure of the private information.

(i) When there is possibility that the user or the third person’s life, body, property, and other rights or benefits get damaged.

(ii) When there is possibility that it harms our proper business process considerably.

(iii) When it violates laws.

Regardless of the three above, we basically do not disclose information which doesn’t apply to the private information such as historical information or characteristic information.

 

 

Revision and Deletion of Private Information

The user has the right to request us to revise or delete his/her private information when the information we have is not correct.  We process as the request right away if we judge that we need to do so, and we inform the result to the user.

 

 

Stopping Our Using Private Information

Our website uses “Google Analytics” which is a traffic analysis tool by Google.

“Google Analytics” uses Cookie to collect the traffic data.  This traffic data is anonymous, and does not specify a specific individual.  The user can refuse collecting the traffic data by disabling Cookie.  If you wish to do it, please check the setting of your browser.  For more details of this rule, please click here.

 

 

Advertising

Our website uses “Google Adsense” which is an advertising delivery service of the third parties.

The advertising delivery company can use Cookie to select advertisings which suit the user’s interests.  For details of the setting to stop Cookie and “Google Adsense”, please refer to “Advertising  – Privacy and Terms, Google”.

 

In addition, our website is a member of “Amazon Associates Program” which is an affiliate program established for the website’s earning referral fee by advertising Amazon.co.jp and place the links in the website.

 

Third parties can provide contents/advertising, collect information from the user directly, and set Cookie in the user’s browser or recognize Cookie from the browser.

 

 

Comments on Our Website

We sometimes record the Internet Protocol address which the user used when making a comment for management against spams and trolls.

 

The collected Internet Protocol address will not be used for any other reasons except for the management against spams and trolls.  All the comments will be placed on our website after checking the contents at our side in advance.  The comments which contain the following things can be defied and deleted by us.

  • Comments which slander specific natural person or corporation
  • Comments which contains indecency contents
  • Comments which are related to illegal business or behavior such as trade of prohibited goods or damaging the others
  • Comments which are contrary to public order and morality, and ones which we judge that it is not appropriate to approve

 

 

Exemption Clause

Copyrights, image rights, and other related rights of the photos or pictures which are used on our website belong to each owner.  We always respect these rights.  If you find any articles, photos, or pictures which infringe on the rights which you own, please contact us by yourself.  We will check the problems and take necessary process.

We cannot take any responsibility for the problems on other websites which are linked from our website.

We are always trying to provide as accurate information as possible on our website.  However, it is possible to occur that wrong information or old information get contained.

Please understand that we will not take any responsibility for any inconvenience resulting from the contents/information of our website.

 

 

Governing Law and Jurisdiction

Our policy’s approval, validity, and interpretation follow Japanese law as the governing law.

Tokyo District Court will have exclusive jurisdiction in the first instance in respect of conflicts between the users and us which are related to, or result from our sales items and services (including published information and advertising).

 

 

Policy Modification

We comply with laws of Japan regarding privacy information, and we keep reviewing our policy for improvement.  Our policy can be modified without informing to the users.

The modified policy will have its force at publishing on this website, except in case that we specially mention the timing.
